SMS Compliance Terms

These terms describe how BasimDigital handles SMS consent, text message programs, opt-out requests, support instructions, and mobile data sharing.

1. SMS Program Sponsor

"BasimDigital," "we," "us," and "our" refer to BasimDigital as the umbrella organization for BasimDigital Lab and related businesses, brands, products, platforms, ventures, and services. Related businesses may include current or future BasimDigital-operated platforms such as Memovara, DocPorta, NexaOS, Baritom/Boritom, TheVotingStation, PABSmartPrep, ProgramBook/PrintOps, cloud modernization work, and other affiliated offerings.

Some SMS messages may identify a specific related business, platform, or project workspace. Product-specific SMS terms may apply for a specific related business if that product provides separate terms.

2. Consent to Receive SMS Messages

By providing your mobile number and opting in through a BasimDigital form, project intake workflow, account setup process, signed agreement, event registration, support workflow, or other clear consent method, you agree to receive SMS and MMS messages from BasimDigital and applicable related businesses at the number you provide.

Consent to receive SMS messages is not a condition of purchasing any product or service. If you provide a phone number on behalf of an organization, you represent that you are authorized to provide that number and receive messages related to that organization or project.

3. Types of Messages

BasimDigital SMS programs may include:

  • Project intake confirmations and discovery scheduling.
  • Client workspace, account, login, verification, and security messages.
  • Project status updates, milestone reminders, document requests, file upload notifications, and next-action reminders.
  • Support, service, billing, administrative, and operational notices.
  • Limited marketing or educational updates only where permitted and where you have provided any required consent.

4. Message Frequency

Message frequency varies by program, project, and user activity. For general project intake or marketing programs, you may receive up to 4 messages per month. Active client workspaces, support requests, authentication, service alerts, project milestones, or transactional workflows may generate additional messages when needed to deliver the service.

5. Message and Data Rates

Message and data rates may apply. Your mobile carrier may charge fees for SMS, MMS, data, or other wireless usage according to your mobile plan.

6. Opt Out Instructions

You can opt out of BasimDigital SMS messages at any time by replying STOP to any BasimDigital text message. We may also honor common opt-out keywords such as END, CANCEL, UNSUBSCRIBE, or QUIT. After you opt out, you may receive one final confirmation message. You will not receive further SMS messages from that program unless you opt in again.

Opting out of SMS does not opt you out of email, portal notices, contractual notices, or other non-SMS communications. It may also not stop messages from a separate BasimDigital-related business or platform if you separately opted into that program; reply STOP to that program as well.

7. Help Instructions

For help, reply HELP to any BasimDigital text message or contact us at hello@basimdigital.com. Help responses may include contact information, program description, opt-out instructions, or links to these terms.

8. Mobile Data Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All data-sharing categories in our Privacy Policy exclude text messaging originator opt-in data and consent. SMS opt-in data, SMS consent records, and mobile numbers collected for SMS purposes will not be shared with any third party for marketing or promotional use.

We may share limited SMS-related information with service providers that help deliver messages, manage opt-outs, maintain consent records, secure systems, prevent fraud or abuse, comply with law, or fulfill a request you make.

9. Privacy

SMS-related personal information is handled under our Privacy Policy. We may keep consent records, opt-in source details, timestamps, message history, delivery status, HELP/STOP requests, and related logs as needed for compliance, support, security, and audit purposes.

10. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on carrier networks, device settings, coverage, and other factors outside BasimDigital's control.

11. Number Changes

If you change, transfer, or deactivate your mobile number, you agree to update your BasimDigital contact information or opt out before the number is reassigned. You are responsible for any messages sent to a number you provided until we receive and process updated information or an opt-out request.

12. Eligibility and Acceptable Use

You may not use BasimDigital SMS programs to send unlawful, abusive, deceptive, fraudulent, or unauthorized messages. BasimDigital may suspend or terminate SMS access where required by law, carrier rules, provider policy, security risk, or abuse concerns.

13. Changes to SMS Terms

We may update these SMS Compliance Terms from time to time. The updated version will be posted at basimdigital.com/legal/sms-compliance with a revised effective date.
